Programs - Intellectual property of programmer or company?

I don't know if this should have been a poll post or not, but I have a question for all programmers out there. Do you consider the programs you make your intellectual property, or that of the company you work for? Also, if anyone has knowledge of the legal standpoint of this question, what is the law regarding this?

If this is were you work, & are payed for the work, then it belongs to your employer.
You can have no clam to it.

If you did this special process/programing away from your work, with your own software, then you could have some clam to it, But this would have to of been, arranged with your employer before you presented it, at your place of work

It's work for hire. Same thing in the software industry: if they're paying for your time while you're doing the work, then it's theirs.
